Dues and Charges ratification for services applied to vessels
entering in Ukrainian merchant ports

      1. The mentioned dues and charges (pilotage dues, dues for usage of traffic control systems, mooring dues, tugboat hire for mooring, harbor craft hire, charges for complex service of lighters, agency fees, supervision remuneration) shall be established in the sea ports referring to vessels and floating objects, sailing under the state flag of Ukraine or foreign flags, namely:

  Group
      cargo vessels calling at ports for cargo operations and floating objects A
      passenger vessels and ferries calling at a port for cargo-passenger operations, ice-breakers neither belonging to port of call nor hired by it B

            Notes:
1. "Calling for refuge" means ship's entering a port when there is a threat to further safe navigation, crewmembers' and passengers' lives or health.
2. Vessels ascribed to Groups C (tugboats and barges), E and F, performing commercial cargo voyages shall belong to Group A.
3. Vessels ascribed to Groups E and F, performing commercial cargo-passenger voyages shall belong to Group B.
4. The way the dues and charges are calculated and applied shall extend to participants in business of any form of property who do some work or render services in the sea ports or on the quays of the ship-repair yards of Ukraine, no matter what administrative authority these ports (quays) may belong to.

      2. Payment of dues for transit passage of the Kerch-Yenikalsky Canal (KEC) and Prorva Canal shall be performed by means of pre-payment, in lack of which it shall be performed immediately on entering the Canals if nothing else is stipulated.

      3. Port dues and charges for services rendered to vessels in the commercial sea ports of Ukraine shall be based on the ship's conditional volume evaluated in cubic meters by multiplying the ship's three particulars (length, breadth and moulded depth) specified in the Measurement Certificate (main dimensions) or other document substituting it.
      For sea vessels carrying cargo on the upper deck or which have two or more decks, the moulded depth used in the calculation shall be half the vessel's breadth.
      For vessels of Group B which have two or more decks the ship's moulded depth used in the calculation of ship's volume shall be half the vessel's breadth.
      The conditional volume of pusher barge systems, convoys of vessels and other compound floating objects shall be estimated for all dues and charges as the aggregate volume of the components.
      The conditional volume of RO-RO, RO-FLOW, OBO, container ships, cattle-carriers, LASH-carriers, car carriers shall be applied with a coefficient of 0,7. The ship-s type and specialization shall be determined by using the ship-s documents.
      Dnepro-Bugsky port Dues and Charges shall be paid directly to "Sea Governmental Administration of Dnipro-Buzhskij port". (Sixth paragraph of Article 3 with changes as per Ministry of Transport Order # 10 ( z0046-03 ) dated 09.01.2003 )

      4. Vessels being serviced at anchorage shall pay additional charges for launches or tugboats separately for each hire of the launches or tugboats.

      5. Lighter-carrying vessels performing cargo operations with lighters in outer or inner roads shall be charged for the aggregate volume of lighters discharged on arrival and loaded prior to departure from the port.

      6. The rates of port pilotage and mooring dues, tugboat hire for mooring, harbor craft hire, payment for services rendered by the agent shall be subject to the following surcharges for all vessels:
  • on weekdays from 22.00 to 6.00 - 25%;
  • on Saturdays, Sundays and holidays by the calendar:
    from 6.00 to 22.00 hrs - 50%,
    from 22.00 to 6.00 hrs - 100%.
  •       These surcharges shall apply only to the part of the cost of the service which corresponds to the actual duration of overtime.
          To self-propelled river-type vessels (non-self-propelled barges) as well as cruise passenger ships calling to Yalta port these surcharges not applied.
          Invoices issued to shipowners shall contain a detailed calculation of the costs of services rendered, mentioning the rates and surcharges applied and indicating the duration of the work, both during the official working hours and overtime.
          The rates of port pilotage dues shall not be increased if a ship is forced to stay at night waiting for permission to enter the canal.

          7. The main attributes of a foreign-going line shall be as follows:
    • establishment of obligatory and optional foreign and Ukrainian ports of call;
    • assignment of types of vessels for operation on the line;
    • establishment of regular intervals of calling at Ukrainian ports by assigned vessels;
    • registration of the line at the State Department of Merchant Marine and River Transportation on presentation of the port (sea port) administration.
          8. Port authorities may grant a discount on all dues and charges in the amount of 50% for vessels calling at Yuzhny port for loading of general and bulk cargoes.
          Following discounts shall apply on dues and charges for services rendered in the commercial sea ports of Ukraine to cruise passenger foreign-going vessels of Group B (excluding those performing cargo-passenger operations):
  • in the port of Yalta - 20%;
  • in the port of Odessa - 10%.

          9. If more than one surcharge apply to a vessel, each of them shall be calculated proceeding from the base rate.

          10. If more than one discount apply to a vessel, only the largest in respect to the base rate shall apply.

          11. When estimating the dues and charges, the duration of rendered services shall be approximated to 0.5 of an hour, a period of time less than 30 minutes being considered as 0.5 of an hour, while a period of more than 30 minutes shall be considered as one full hour.
          In cases of estimation of dues and charges per day (24 hours), the duration of rendered services shall be approximated to 12 hours, a time period of less than 12 hours being considered as 12 hours, while a time period of more than 12 hours shall be considered as 24 hours.

          12. The state affiliation of a vessel and its corresponding status for collection of port dues shall be determined by the flag, under which the vessel is sailing, independent of the affiliation of its owner or operator.

          13. Port dues shall be paid in accordance with Decree of the Cabinet of Ministers of Ukraine # 15 (15-93) dated 19th February 1993 "On System of Currency Regulation and Control".

          14. Value added tax according to the Ukrainian legislation shall be paid on the amount of port dues, paid in the national currency. At this, the amount of dues, determined by the present regulations, for services rendered to vessels in coastal voyages, shall be increased by the amount of value added tax; in other cases the amount of VAT payable to the budget shall be calculated proceeding from the amount of dues collected in port without such increase.

    PILOTAGE DUES

          15. Pilotage dues shall be collected from all vessels calling at Ukrainian ports. For vessels under Ukrainian flag pilotage is not compulsory and Pilotage Charges shall not be collected in the following cases:
      - when pilotage in the region or port is not compulsory;
      - the Shipmaster has passed the examination to the Commission of the Harbormaster and has received the corresponding Certificate.
          16. Estimation of Pilotage Charges shall be performed proceeding from the volume of the vessel in cu.m. The volume of vessels that is less than 5000 cu.m. shall be considered as being 5000 cu.m.

          17. Pilotage Charges shall include payment for a pilot vessel or any port craft used for delivery of the pilot to an arriving vessel or removing a pilot from a departing vessel.

          18. Vessels of groups A, B, D and E shall be charged for pilotage of vessels to port along canals and fairways, between a port and localities beyond the port limits (coastwise pilotage), as well as for the maneuvering of a vessel from outer roads to its berthing place in the absence of canals and fairways, or any shifting inside a harbor (harbor pilotage), according to the volume of the vessel cu.m. at the following rates:

          19. Pilotage Dues from self-propelled vessels of group C for coastwise pilotage shall be collected per 1 km. and 1 kW of effective capacity of the tugboat or per 1 ton of carrying capacity of other self-propelled vessels at the following rates:
    • 0.002 USD - for vessels on foreign-going voyages.
          Incomplete kilometer of pilotage accepted as complete kilometer. Pilotage dues for harbor pilotage (between outer roads and the berth) shall be collected for 1 kW of effective capacity of tugboat or per 1 ton of carrying capacity of other self-propelled vessels at the following rates:
    • 0.04 USD - for vessels on foreign-going voyages.
          Tugged or pushed non-self-propelled vessels of group C shall be charged at 25% of the rate of dues for the tugboat. At this, dues for the tugboat shall be collected according to the full rate.

          20. Pilotage Charges for the pilotage of vessels which are passing by transit through the Kerch-Yenikalsky Canal shall be collected at the following rates irrespective of the time of pilotage:
      - 0.0288 USD per cu.m. - for vessels on foreign-going voyages.
          For the pilotage of vessels in the Sea of Azov - at the following rates irrespective of the time of pilotage:
      - 0.0223 USD per cu.m. - for vessels on foreign-going voyages.
          Pilotage charges for the pilotage of vessels which are passing in transit through the Kerch-Yenikalsky Canal towards the Port of Kavkaz shall be collected at the following rates irrespective of the time of pilotage:
      - 0.021 USD per cu.m. - from Buoy # 1 to the port of Kavkaz;
      - 0.0082 USD per cu.m. - from Varzovsky Buoy to the port of Kavkaz.
          The rates shall not be increased on Saturdays, Sundays and holidays.
          Pilotage in the approaching canals of the ports shall be paid separately according to the rates of Table 1.

          21. A discount of 20% shall be applied on coastwise and harbour pilotage rates for vessels working in the scheduled ports of foreign-going lines and to vessels of group B.

          22. Vessels of group F (except vessels under running tests) shall be exempted from Pilotage dues.

          23. A Shipmaster, having declared incorrect figures about his vessel's draught, length, breadth and tonnage, shall be fined at the double rate of the prescribed Pilotage dues, irrespective of any liability stipulated by the Law for consequences which may arise due to inaccurate information.

          24. A pilotage distance of less than one mile shall be considered as being of one full mile.

          25. In the case of simultaneous pilotage of several vessels, Pilotage dues from each vessel shall be collected at the full rate.

          26. Dues shall be collected on the basis of a pilot receipt issued and signed by Master or on the basis of the vessel's radiotelegraph confirmation.

          27. Cancellation of request for pilotage or detention of pilots aboard vessels shall be chargeable at the following rates:

          Notes:
    1. Detention of the pilot for more than two hours in cases when the period of pilotage itself exceeds two hours shall not lead to the mentioned payments.
    2. If a pilot and probationer were carried by a vessel which they were piloting, outside their service region, the shipmaster shall reimburse the pilot the expenses for returning to pilot's place of service (fare, per diem expenses, hotel accommodation) and shall pay the rate as per Table 2 for each day of pilot's stay outside the service region.

    DUES FOR TRAFFIC MANAGEMENT SYSTEM

          28. Dues for services of the Vessels Traffic Management System (VTMS) equipped with Coastal Radar System (CRS) shall be collected at the following rates per one cu.m. of the volume from vessels of groups A, B, E and F (vessels under running tests) for each inward and outward passage, as well as for each passage in transit through a canal.

          Notes:
    1. Vessels of groups C, D, F (except vessels under running tests) shall exempted from the charge for the services of VTMS.
    2. Vessels which are passing in transit through the Bugsko-Dneprovsky canal and the Kherson sea canal in order to call at the river ports shall pay the VTMS dues to the state enterprise "Delta-Pilot" according to the rates of the sea port of Nikolaev and the sea port of Kherson respectively.
          The mentioned dues shall be collected with a discount of 70% for transit passage of VTMS of the ports of Ilyichevsk, Odessa and Yuzhny in the following:
      1) limited visibility;
      2) at request of the Shipmaster under any conditions of visibility.
          For the ferries of the Ilyichevsk v Varna ferry line and high-speed hydrofoil ships on regular passenger voyges as per schedule a 50% on the dues shall be applied.
          Dues for the VTMS services shall be collected for services actually rendered.
          If no services have been rendered (the coastal radar system is not operational or just no services have been given) the VTMS dues shall not be collected.

          29. Loaded gas-carriers, chemical-carriers and tankers passing in transit shall be subject to compulsory radar pilotage by VTMS of the port of Ilyichevsk at the following rates:
    • 0.0006 USD per cu.m. per mile - for vessels on foreign-going voyages.
          Charges for passage through VTMS by transit shall be included into the disbursement account at the nearest port of arrival (departure) of the vessel with subsequent transfer of the funds to the corresponding ports.

          30. A shipmaster who, having ordered the services of VTMS, later rejects them, shall pay the full amount of dues for ordered services.

    MOORING DUES

          31. Mooring dues for mooring, unmooring, dragging alongside a wharf or shifting from one wharf to another of vessels of all groups, except C, D and E and F shall be collected at the following rates:

          32. The dragging of a vessel alongside a pier at a distance exceeding the vessel's length shall be considered as two operations; at a shorter distance - as one operation.

          33. Shifting of a vessel from one berth to another shall be considered as two operations.

    TUGBOAT HIRE FOR MOORING

          34. Vessels of Groups A (except floating objects) and B (cruise passenger ships on foreign-going voyages calling at the port of Yalta) and C (except tugboats, pushing tugboats, pushers) shall be charged in complex for the hire of all tugboats used for mooring, unmooring and shifting according to rates of Table 5.

          35. The rates of Table 5 shall be applied in the absence of ice conditions and with wind speed up to 14 m/sec.

          36. Under ice conditions or wind speed of more than 14 m. per sec payment for the work of tugboats during mooring, unmooring and shifting shall be performed according to the rates of Table 6.

          37. The amount and capacity of tugboats necessary for mooring and unmooring shall be established by Compulsory Port Regulations or determined by the Pilotage Service in agreement with the Shipmaster.

          38. A discount of 20% shall be granted to vessels of group A in scheduled ports of intergovernmental lines.

          39. A discount of 25% percent shall be granted to vessels using bowthrusters during berthing operations.

          40. Vessels of all groups with main engine being out of order or not in operation shall he charged for tugboat service during mooring, unmooring and shifting as non-self-propelled vessels (dumb craft).

          41. Vessels of Groups A (floating objects), C (tugboats, pushing tugboats, pushers), B (except cruise passenger ships on foreign-going voyages calling at the port of Yalta) and vessels of Groups D, E and F shall be charged for tugboat service during mooring, unmooring and shifting according to rates of Talbe 6.

    HARBOR CRAFT HIRE

          42. The hire of harbor self-propelled craft in all cases, except those stipulated in article 34, shall be chargeable according to the rates of Table 6.

          43. The hire of harbor dumb craft shall be chargeable according to the rates established by Manager of the organization owning the craft.

    AGENCY FEE

          44. The agency fee of vessels calling at Ukrainian ports for loading and/or discharging liquid, bulk, general, timber and mixed cargoes shall be remunerated according to the rates of Tables 7, 8 and 9.

          45. The agency fee of vessels calling at Ukrainian ports for purposes other than cargo and/or passenger operations, shall be remunerated according to the rates of Table 10.

          46. The agency fee of vessels passing in transit through the Kerch-Yenikalsky Canal shall be remunerated at 50% of the rates of Table 10.

          47. The agency fee of passenger vessels and private yachts calling at Ukrainian ports shall be remunerated at rates of Table 11.

    ADDITIONAL AGENCY SERVICES

          48. Liner vessels at ports of loading and/or unloading shall remunerate the agent for services of booking of cargo, collecting and remitting freight, drawing up documents, etc. in the amount of 5% of the gross freight for import and export cargoes, if not otherwise stipulated by a liner agency agreement.

          49. The rendering of services, protection of the Shipowners' interests, performed on their commission shall be chargeable in the amount of 35% of the relevant basic agency fees.

          50. In cases when a vessel calls at port for discharging and subsequent loading of cargoes, a 25% discount shall be granted on the second operation.

          51. A 25% discount shall be granted to a vessel in cases when less then 25% of its carrying capacity is employed in loading or discharging of the cargo at the same port (liner vessels excluded).

          52. In cases when the period of the vessel's stay at port exceeds 10 days a 15% surcharge on the basic fee shall be collected for each succeeding full or incomplete 5 day period.

          53. For vessels carrying over 10 tons of dangerous cargoes and calling at port for cargo handling operations a 25% surcharge on the basic fee for rendered services shall be collected. A list of dangerous goods is given in the International Maritime Dangerous Goods Code.

          54. Vessels, calling for repair shall be given the same status as vessels calling for purposes other than cargo and passenger operations.
          In cases when the period of the vessel's stay at the port for repairs exceeds 5 days, an additional payment shall be collected for each succeeding complete or incomplete 5-day period in the amount of 25% of the basic rate of agency remuneration.

          55. In case of fumigation of cargo a charge of 50% of the relevant rate of Agency Fee shall be collected for arrangements and complex services, excluding expenses on motor transport, meals and accommodation of crew members at a hotel.

          56. Vessels shall pay for petty services (including bank commission) rendered by Agent for Shipowner (USD per call):

          57. Payment for telephone, telegraph, telex, fax communication must be grounded on real expenses with adding of 1,5 coefficient (for communication rent).

    SUPERVISION

          58. Services of supervisors shall be remunerated for services actually rendered according to piece rates fixed in Tables 12 and 13.

          59. Servicing of vessels calling at the port for repairs, bunkering or supply shall be charged at the following rates:
      - 27 USD per day - for vessels on foreign-going voyages.

          60. For actual rendering of services prior to receiving free pratique, in cases when a supervisor's attendance is requested by the Master of a vessel staying in roads, when no cargo is handled, as well as after the vessel's departure, the remuneration shall be collected at the relevant rates provided for 24 hour periods.

          61. A 10% surcharge shall be collected on remuneration of supervision services rendered to vessels calling at a port for cargo operations with dangerous goods (more than 10 tons).
          No supervision remuneration shall be charged for vessels-passing in transit through the Kerch-Yenikalsky Canal.

    OTHER SERVICES

          62. Removal of polluted materials by port facilities shall be charged at rates, established by Port president in the following cases:
      1) removal of emulsion and ballast waters;
      2) after 30 days of vessel's staying in the port;
      3) vessels of groups B, C, D, E and F from which sanitary dues are not collected;
      4) at ports, which do not have facilities for removal of all polluted materials.
          Additional services not mentioned in the present regulations shall be paid for according to tariffs approved by general directors of the ports and heads of shipping agencies respectively. At this settlements with national shipowners shall be performed on agreement of the parties.
